Terms of Sale

The placing of a bid shall constitute acceptance of all conditions of sale.

1. All bids are per lot numbered in the catalog: the right is reserved to withdraw any lot prior to sale, or to act on behalf of the seller. Lots will be grouped only at the discretion of the auctioneer; his decision is final.

2. The auctioneer shall regulate the bidding and reserves the right to refuse any bid believed by him not to be made in good faith; in the event of a dispute, the decision of the auctioneer shall be final. Unreasonably limited bid sheets cannot be accepted; your "limit" should represent a significant percentage of your total bid sheet (i.e. bidding on 20 items for a total of $500 and limiting the total of your purchase to $50).

3. The highest bidder shall prevail at one advance over the second highest bidder. Unlimited or buy bids are not accepted.

4. There is a 15% buyer's premium added to the hammer price.

5. Mail bids are accepted up until the day of sale. No bids are accepted for less than 50% of the ECV. In event of identical mail bids, the earliest received shall prevail. No unsigned bid sheets are accepted. Use the bid sheet in the catalog. Observe the bidding increments. Bid in US dollars.

6. All phone bids must be confirmed in writing. We will act on behalf of the mail bidder and will enter all bids via mail or telephone with due diligence. However, we accept no responsibility for errors in either understanding or executing bids. Phone bids made within 7 days of auction by bidders unknown to us must be secured by Visa, Master Card or American Express numbers and expiration date. You may confirm phone bids by faxing your SIGNED bid sheet to (407) 645-4434.

PAYMENT
7. The terms of sale are strictly cash on delivery to the winner unless other arrangements have been made prior to the auction. State sales tax must be paid as appropriate; dealer Florida tax number must be on file.

8. Successful bidders are expected to make payment in full before lots are delivered, immediately upon notification. All foreign bidders must make payment in US funds drawable upon a U.S. bank. Bidders who have established credit or who supply acceptable philatelic reference may have lots forwarded in advance of payment, though first purchases from all new bidders must be prepaid. Bidders who have established credit are expected to remit on receipt. No claims or returns accepted for any reason (except authenticity) after 14 days of receipt. Proof by the auctioneer of receipt of sending at the address submitted with the bid sheet shall constitute delivery. Lots paid for by American Express, Visa or Mastercard are shipped at once, subject to credit verification.

9. Until paid in full, all lots remain the property of MICHAEL ROGERS, INC. on behalf of the seller. If payment is not received on time, we have the option to offer any lot to the underbidder. Auctioneer reserves the right to dispose of all lots without notice to the defaulting buyer if payment is not made under the terms specified herein, and the defaulting buyer agrees to pay the reasonable costs of such subsequent sales; should a lower price be obtained, the defaulting buyer further agrees to pay any such difference to the auctioneer. LATE REMITTANCE MAY BE CONSIDERED JUST CAUSE TO REVOKE ALL RETURN PRIVILEGES.

10. If purchase price has not been paid within the time limits agreed, a late charge of 1-1/2% per month shall be imposed on overdue payments. If legal action is required, all expenses are to be paid by the bidder, and all matters arising on account of this auction shall be construed under laws of the State of Florida. Jurisdiction shall be in Orange County, State of Florida.

11. All cost of mailing lots will be paid by buyer. Successful purchases are shipped via Express. Standard charges are $18 within the United States and $30 for most Foreign destinations. There are additional charges for insurance and bulky lots. Please be sure to provide us with a street address and telephone number for delivery.

12. All returned lots are at expense of buyer.

AUTHENTICITY
13. All lots are sold as genuine and correctly described; if in the buyer's opinion a description is incorrect, the lot must be returned intact within 14 days of receipt. If an extension of time is required for submission of a lot to a mutually acceptable authority for expertisation, the buyer must notify us within 14 days of receipt that an opinion is being sought, together with the name of the authority (and expected date of the opinion). The sale shall remain open until an opinion is rendered; however, no returns will be accepted under any circumstances more than two months from the date of sale. A finding of "no opinion" is not grounds for the return of a lot. All expenses for expertisation will be borne by the buyer except in the case that a lot is proven not to be as described, in which case the seller will refund the actual costs, not to exceed $50 per lot.

14. All lots for which an opinion is sought must be paid for at the time of notification.

15. The following lots are not returnable under any circumstances: lots containing 10 or more items, lots from purchasers who have had the opportunity to examine them prior to the Auction, (except in the case of authenticity), lots described with defects, faults or repairs of any kind, or illustrated lots on account of factors visible in the illustration, or lots described "AS IS".

16. All returned lots must be returned in the condition received by the buyer. Recently an expertising service has started to offer a grading and encapsulating service. Under no account will we accept return of an encapsulated stamp.
